Class Action Lawsuit against Dr. Jimenez.

My name is Amber on October 13th 2009 I made a call out to any of Dr. Jimenez's patients who have been wronged to come together and take action.

On October 14th he reported me to the C3 internet crime agency and filed a false police report in retaliation.  He CC'd me these actions.

Dr. Jimenez has been actively slandering me, telling blatant lies about this own actions, me personally via email, phone and voicemail.
 

I also personally informed his crimes against myself to the Medical Board of Hawaii on Oct, 5 2009 the second state he is fighting to keep his medical license.

Summary & updates:

• Dr. Jimenez lost his license to practice medicine in the state of California

• To keep his HI license he greed to completely disassociate himself from medical marijuana

• 8/26/2009: He sent a fraudulent medical bill to the IT person taking over for me. Who then contacted me for help. Dr. J expected I would support him abusing another and that I would go back to being his full time webmaster.

• 10/5/2009: I made contact and explained his crimes against myself to the Medical Board of Hawaii on Oct, 5 2009

• 10/13/2009: An email was sent announcing the organization of this class action lawsuit attempt with a link to this site.

• Those who received the email were on a list provided to me by Dr. J with instructions to use it announce the new website I was working on for him, updates and any MM relates, links or media.

• 10/14/2009: He fraudulently reported me to the C3 internet crime agency and filed a false police report in retaliation

• He bought the domain ambervictor.org and got a web developer to post slanderous things about me and attempted extort 25K o 'rent' the domain for $1200 so I could take down the site.

• His harassment of me continues to escalate. He sends me a nude picture of himself saying 'suck it'

• 12/4/2009: Message left on my voicemail asking me to be his web developer and create a website for a new product he is attempting to sell, SoBe cosmetics. After all the horrible things he has done to me, said to me and about me he had the audacity to ask me to do more work for him, to be his developer again.

• 12/14/2009: He agreed to trade ambervictor.org the DrJimenez.org a one for one trade plus my out of pocket expenses

• He agreed to pay my out of pocket /zero profit costs $525 for his hosting, domain renewals and email, his business expenses.

• He paid the $525 via PayPal.

•  I decided to gift him the other domains he wants, I made it clear our agreement had not changed and I retained the right to change my mind

• DrJimenez.org transferred to his full control and his own GoDaddy account, the others (which I was under no obligation to transfer to him) were put on hold by GoDaddy due to contact / WHOIS information changing. All there was left to do was wait.

• Dr. J began harassing me and GoDaddy to no end. He demanded I call GoDaddy to fight them to remove the hold. The call was not necessary and I refused to watse my time. After much harrassment I tol d him I woud change $40 for the call wihtr no guarntee the holds woud be lifted and a max of one hour of my time woud be spent.

• GoDaddy lifted the hold only after I agreed to join their Bulk Domain Owner Club for 89.99 a year. The money was taken from my account.

• Dr. J was informed the hold could be lifted and the transfers would go through anywhere from a few minutes (as DrJimenez.org did) to a week.

• He filed a fraudulent dispute with PayPal to get his money back AFTER the DrJimenez.org site was transferred to him and he thought the others could not be stopped.

• I did not receive ambervictor.org

• I received an email from him that said "I am through with you"

• 12/15/2009: His techie Chris acknowledged the agreement (Dr.J authorized Chris to transfer upon receipt of drjimenez.org, from the beginning) and refused to be part of Dr. J's unethical behavior and put  ambervictor.org in my name. Pre- that Chris removed the slanderous babble DrJ had him put up.

• 12/18/2009: I have turned over his past due invoice to a collection company.

Note:

I ask / plead that no one who supports this class action contact him personally.

We are not the bad guys and let us not let our emotions or his dishonorable actions get in the way of us acting lawfully and civilly.

 

I can only describe him as beyond very manipulative.

 

I witnessed him harass and poke via email I was CC'd the IT person before me until they emailed a verbally hostile response back to defend themselves.

Dr. J then used that email against him. He played the wounded bird and I believed him.

Of course Dr. J did not share the dozens of horrible emails he sent the IT guy first.

At the time it was beyond my comprehension anyone behaves as Dr. J. Since I have apologized to that IT person.

 

He tried that trick with me and contacted me countless times dozens and dozens and despite the fact I did not reply or acknowledge these provoking emails and answering machine messages he began to write in his harassing, threatening, slanderous and lie filled emails he would file a TRO against ME if I did not stop harassing him! Only he was doing the harassing.

He has accused me of everything he is the one doing. It seems he think a false accusation will serve as a mean to backup his lies .

 

Existing & Former Patients: I do not have your patient records and never have.

I NEVER accessed his patient files or had them in my possession.

 

10/13/2009: An email was sent announcing the organization of this class action lawsuit attempt with a link to this site.

The recipients of that email came from a list provided to me by Dr. J; I was told to use the list to announce when his new website was online and other Cannabis related news, information and media.

He claims he has over 10,000 patients, the list he gave me had less then 1,000 email addresses, email addresses only no other information.

 

I have written proof he gave me the list and authorized me to use it.

Also, I got replies from non-patients this proves the list was not a patient list or file.

 

If any laws were broken it was Dr. Jimenez who broke them. I have no control over what he chooses to email me.

He knew it was his responsibility to assure I received no confidential information that is in the contract he signed.

His most common and grossly overused "It was a misunderstanding" excuse does not pass go.

Why the class action and what prompted this effort?

I have received many responses curious about what prompted me to organize this class action.

In summary I have witnessed crimes not only done to me but others:

Abuse of power, negligence and malpractice, breaching patient confidentiality, extortion, slander, false police and other law enforcement reports, blackmail, coercion, fraudulent billing practices, harassment and pathological lying.

Against me personally ad others.

 

Lawsuit info / disclaimer:

I am need of a few more people to come forward to justify moving forward with this class action effort.

So far I have a lot more emails requesting participate then official sign-ups form this website which we have 9 required users now.

 

I will not share your name with anyone until permission is given on a signed form.

Signing up on this website does not obligate anyone to participate down the road.

 

You are welcome to pursue your own personal lawsuit and remain on the list for this potential action.

I need to be careful in my wording and representation of this effort to avoid being liable if this does not end how people want it to. I am not as trusting as I was before my experiences with Dr. Jimenez.

 

Do not let this action stop you from seeking to immediately remedy any issues you have with Dr. Jimenez. Together we can stand strong and I feel extremely confident justice will be served but obviously cannot guarantee the outcome of this action.
